The revised Renewable Energy Directive (Directive (EU) 2023/2413, RED III) changes the sustainability requirements and greenhouse gas reduction targets for the promotion of biomass use in electricity and biofuel production. The Biomass Electricity Sustainability Ordinance (BioSt-NachV) and the Biofuel Sustainability Ordinance (Biokraft-NachV) must be amended to transpose these new requirements into national law.
The draft bill also aims to improve fraud prevention as stipulated in the German government’s coalition agreement to the extent permitted by national law.
For legal reasons, the BioSt-NachV and Biokraft-NachV are being amended largely in parallel. This will preserve the legal criteria for mutual recognition of certified biomass in both ordinances and prevent additional work for economic operators and government authorities.
